These Terms of Service (“Terms”) govern your access to and use of the MyParental parental control application, website, and related services (collectively, the “Service”), provided by MyParental (“we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
This document is provided for informational purposes and is not a substitute for legal advice. The actual Terms of Service on your live website should be reviewed by a qualified attorney in your jurisdiction before publication.
1. Who Can Use MyParental
1.1 Age and Authority
To create a MyParental account, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction).
- Be the parent or legal guardian of any minor child whose device will be connected to the Service.
- Have the legal authority to consent on behalf of that child to the collection and processing of their information for parental control purposes.
- Provide accurate information when creating your account and keep it up to date.
If you do not meet these requirements, you may not use the Service.
1.2 Intended Use
The Service is intended exclusively for use by parents and legal guardians to support the digital safety of their own minor children, on devices the parent or guardian owns or shares with the child, with the knowledge of the child.
The Service is not intended for, and you agree not to use it for:
- Monitoring any adult without their explicit, informed, and ongoing consent.
- Monitoring a current or former spouse, partner, romantic interest, or any other adult.
- Monitoring employees, contractors, or any other adult workers.
- Any form of stalking, harassment, intimate partner abuse, or surveillance of a person who has not consented.
- Monitoring a child who is not your legal minor dependent, unless you have the explicit consent of that child’s parent or legal guardian.
- Any use that violates applicable law in your jurisdiction or the jurisdiction where the monitored device is used.
Violation of this section is a material breach of these Terms and grounds for immediate account termination. We cooperate with law enforcement on credible reports of misuse.
1.3 One Account Per Family
Each parent or family should maintain a single account. Creating multiple accounts to evade limits, abuse trial offers, or circumvent enforcement actions is prohibited.
2. Account Responsibilities
2.1 Your Account
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us promptly of any unauthorized use of your account.
- Ensuring the information in your account is accurate and current.
We strongly recommend enabling two-factor authentication and using a unique, strong password for your MyParental account.
2.2 Your Children’s Awareness
Consistent with our design philosophy and applicable law, you agree to inform any minor child whose device is connected to MyParental that the Service is installed and what it does, in a manner appropriate to the child’s age. The Service is built to be transparent on the child’s device, and you agree not to attempt to hide its presence or otherwise circumvent its visibility.
2.3 Cooperation With Service Operation
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service in a way that could harm, overload, or impair our systems.
- Use automated means to access the Service except as expressly permitted by us.
- Attempt to bypass any technical limitations, access controls, or security measures.
- Use the Service to violate any third party’s rights, including intellectual property, privacy, or contractual rights.
3. Plans, Pricing, and Payment
3.1 Free and Paid Plans
MyParental offers a free plan and paid subscription plans. The features included in each plan are described on the pricing page. Plan details may change from time to time, and we’ll notify existing customers in advance of any material changes that affect them.
3.2 Billing
Paid plans are billed in advance on a monthly or annual basis, depending on the plan you select. Charges are non-refundable except as described in Section 3.5 below or as required by applicable law.
You authorize us to charge the payment method you provide for all fees associated with your account. You agree to keep your payment information current.
3.3 Renewals
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. The renewal will be at the then-current rate for your plan, charged to the payment method on file.
We send a reminder before annual renewals so they don’t take you by surprise.
3.4 Cancellation
You may cancel your subscription at any time through the parent dashboard. Cancellation takes effect at the end of your current billing period — you continue to have access to paid features until then, and your account converts to the free plan afterward.
We do not use retention dark patterns. Cancellation should take a few taps. If you encounter friction cancelling, please report it to support@myparental.app.
3.5 Refunds and Money-Back Guarantee
We offer a 30-day money-back guarantee on initial paid plan purchases. If MyParental isn’t working for your family in the first month, contact billing@myparental.app and we’ll process a refund.
Outside the 30-day window, refunds are not generally provided for unused subscription time, except where required by applicable consumer protection law.
3.6 Price Changes
We may change the price of subscription plans from time to time. For existing customers, any price change:
- Will be communicated by email at least 30 days in advance.
- Will not affect your current billing period.
- Will apply at your next renewal after the change takes effect.
If you do not agree to a price change, you may cancel before it takes effect.
3.7 Free Trial
When a free trial is offered for a paid plan, you may cancel during the trial period without being charged. If you do not cancel before the trial ends, the selected plan begins and you will be charged according to the plan’s billing cycle.
3.8 Taxes
Prices listed may not include applicable taxes. Where required by law, we collect taxes appropriate to your billing location and remit them to the relevant authorities. The total at checkout reflects any applicable taxes.
4. Your Content and Family Data
4.1 Ownership
You retain ownership of the content you and your family generate through the Service. This includes your account information, settings, configurations, and the activity data the Service collects from the connected devices in your family.
4.2 License to Operate the Service
To provide the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display this information for the purpose of operating and improving the Service. This license is limited to what’s needed to run the Service for you and ends when you delete your account, subject to the retention practices described in our Privacy Policy.
4.3 No Use for Other Purposes
We do not use your family’s data for purposes outside of providing the Service. We do not sell it, share it with advertisers, or use it to train AI models that benefit other customers or third parties. See the Privacy Policy for the full details.
4.4 Your Responsibility for Family Data
You are responsible for ensuring that you have the legal authority to use the Service to collect information about each member of your family connected to your account. This typically means being the parent or legal guardian of any minor child whose device is connected, and ensuring that any other adult on the account (such as a co-parent) has agreed to its use.
5. Service Availability and Modifications
5.1 Best Effort, Not Guaranteed
We aim to keep the Service available and working well, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable for maintenance, upgrades, or due to circumstances outside our control.
5.2 Platform Dependencies
The Service relies on Apple, Google, and other platforms to operate. Changes by these platforms — including changes to iOS, Android, app store policies, or specific permissions — may affect what features are available or how they work. We adapt the Service as platforms change, but some changes may reduce or remove certain functionality, sometimes without notice.
5.3 Modifications to the Service
We may add, change, or remove features over time. Material changes that meaningfully reduce functionality you’re paying for will be communicated in advance, and where appropriate we will offer a refund or alternative.
5.4 Discontinuation
If we ever discontinue the Service entirely, we will provide reasonable advance notice and an opportunity to export your data. Active paid subscriptions would be refunded on a pro-rata basis for any unused time.
6. Acceptable Use Policy
Beyond the use restrictions in Section 1.2, you agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right.
- Distribute malware, spyware, or any malicious code.
- Attempt to gain unauthorized access to other accounts or our systems.
- Interfere with other users’ use of the Service.
- Misrepresent your identity or affiliation.
- Engage in any form of harassment, threat, or abuse.
- Use the Service for any commercial purpose not authorized by us.
- Resell, sublicense, or redistribute access to the Service.
We may investigate and take action against violations, including suspending or terminating accounts, removing content, and cooperating with law enforcement.
7. Termination
7.1 Termination by You
You may close your account at any time through the parent dashboard or by contacting support@myparental.app. When you close your account, we delete or anonymize your data in accordance with our Privacy Policy retention practices.
7.2 Termination by Us
We may suspend or terminate your account if:
- You materially breach these Terms, including the use restrictions in Section 1.2.
- We are required to do so by law or legal process.
- We have a reasonable belief that your use of the Service creates legal, security, or operational risk.
- You fail to pay fees for paid plans after reasonable notice.
Where possible, we will provide advance notice and an opportunity to address the issue. In cases involving suspected misuse of the Service against an adult without consent, or other serious violations, we may terminate immediately.
7.3 Effect of Termination
When your account ends, your access to the Service ends. Some provisions of these Terms survive termination — including those related to ownership, indemnification, liability limitations, and dispute resolution — to the extent appropriate.
8. Disclaimers
8.1 As-Is
The Service is provided “as is” and “as available.” To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
8.2 No Guarantee of Outcomes
Parental control software is a tool. It cannot guarantee any specific outcome regarding your child’s safety, well-being, or behavior. The Service is intended to support good parenting, not to replace it. You are responsible for the decisions you make about your family.
8.3 Third-Party Platforms
We do not control Apple, Google, or other third-party platforms whose policies affect what the Service can do. We are not responsible for changes by those platforms that affect Service functionality, nor for the practices of those platforms.
8.4 Information, Not Advice
Content in the Service and on our website — including articles, reports, and alerts — is intended for general informational purposes and is not legal, medical, psychological, or financial advice. For matters in those areas, consult an appropriate licensed professional.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Service.
- Our total cumulative liability to you for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow certain limitations of liability, in which case the limitations above apply only to the maximum extent permitted by law.
Nothing in these Terms limits liability for:
- Gross negligence or willful misconduct
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Anything else that cannot lawfully be limited
10. Indemnification
You agree to indemnify and hold MyParental, its officers, employees, and contractors harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service in violation of these Terms
- Your use of the Service to monitor someone you did not have legal authority to monitor
- Your violation of any applicable law in connection with your use of the Service
- Your violation of any third party’s rights
This obligation survives termination of your account.
11. Dispute Resolution
11.1 Informal Resolution
Before filing any formal dispute, we ask that you contact us at legal@myparental.app so we can try to resolve the matter directly. Most issues can be sorted out without escalation.
11.2 Governing Law
These Terms are governed by the laws of [Jurisdiction], without regard to its conflict of laws principles.
11.3 Venue
Subject to any mandatory consumer rights in your jurisdiction, any formal dispute arising out of or related to these Terms or the Service will be brought in the courts of [Jurisdiction], and you consent to the personal jurisdiction of those courts.
11.4 Consumer Rights
Nothing in this section limits any mandatory consumer rights you have under the law of your country of residence. If you are a consumer in the European Union, you may bring claims in the courts of your home country.
11.5 No Class Actions
To the extent permitted by applicable law, you and we each agree that disputes will be resolved on an individual basis, not as part of a class action, collective action, or representative proceeding.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, the Service, or applicable law. When we make material changes, we will:
- Update the “Last Updated” date at the top of this document.
- Notify you by email or through the Service before the changes take effect, with reasonable advance notice for material changes.
- Maintain prior versions in our archive.
Continued use of the Service after updated Terms take effect means you accept them. If you do not agree, you may close your account.
13. Miscellaneous
13.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
13.3 No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
13.4 Assignment
You may not assign these Terms or your account without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or similar transaction, subject to the limits described in our Privacy Policy.
13.5 No Agency
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
13.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, labor disputes, internet outages, or major platform changes.
13.7 Notices
We may give notices to you by email to the address associated with your account, or by posting them in the Service. You may give us notice at legal@myparental.app or by postal mail to the address below.
13.8 Apple App Store and Google Play
If you obtained the Service through the Apple App Store or Google Play, additional terms from those platforms also apply to your download and use of the app on their platforms. Where there is a conflict between those platform terms and these Terms, the platform terms govern with respect to the app store distribution itself.
